"Copying videos"
 
   I want to copy some ballet tapes (copied off tv so no worries) for a friend, but don't have access to another video recorder. Does anyone know where in London I can do this, and at what cost? Thanks for any help.

   Sorry - don't want to sound sniffy, but copying off TV and then copying DOES have worries - you are more or less allowed to do it for personal use, but you are breaking copyright by copying it for others. I dare say we have all done it - but to say openly that there are no worries ......... If you take it to a commercial firm, that just makes it worse. There are such firms in London, by the way, and one of the cheapest is called Aztec. It is in a mews just off Tottenham Court Road - I don't have the address, but it should be in the telephone directory.

The Video Recordings Act of 1984, Section III (2) clearly states:

"The supply of a video recording by any person is an exempted supply if it is neither a) a supply for reward, nor b) a supply in the course or furtherance of business".

So that's all right then. None of us here are copying videos for 'reward' or 'in the course or furtherance of business'. We're doing it for fun!

Sarah, re. finding a service to do the copying for you, try checking your local yellow pages under 'Video Services'.

   I do not share your confidence, Ann. Although this is not my area of the law, the Video Recordings Act 1984 deals with the criminal offences that might otherwise be committed by supplying a an unclassified video - it was brought in to deal with what were called at the time "video nasties". Supplies in the circumstances you mention are simply immune from prosecution. The 1984 Act is not concerned with breach of copyright - this is governed by the Copyright Designs and Patents Act 1988, and, as far as I can see, the only activity which does not infringe copyright is the "making for private and domestic use of a recording of a broadcast or cable programme solely for the purpose of enabling it to be viewed or listened to at a more convenient time" - Section 70 of the 1988 Act.

Only the making of the original recording seems to be exempt, and only then if it was made for the purpose specified in Section 70. I may be applying too strict an interpretation, but it does look as though making a second-generation recording of the original one for the purpose of supplying the second tape to a friend may not come within the Act.

   When I once tried to find a company to copy a video, the first question all of them asked was "Is it copyright material?", and if so they wouldn't touch it.

however, sarah, vcr's for private use are less and less expensive here (i'm in the u.s.) don't know if that applies where you are but perhaps it would be worth an investment for you to get another one eventually if you could.

   What you need to do is take security copies of your videos and store them off-site somewhere. To avoid any excessive costs I normally ask friends to keep them safe for me....

   Also meant to say that I look after security copies of videos for a few of my friends and periodically check that they are still ok. Nothing worse than having a backup and finding it useless...

   The cost of getting this done commercially far outways that of buying a second VCR. How anyone survives with only one VCR is a complete mystery to me.
